Regulations and Requirements—Meal Services Contracts

Applicability of Federal Requirements to School Food Service Procurements

In August 2000, a final regulation published in the Federal Register moved the procurement procedure requirements for the Child Nutrition Programs from Department regulation 7 CFR Part 3015 to 7 CFR Parts 3016 and 3019. School food authorities are encouraged to share this information with their legal counsel. Please refer to the questions and answers link below for more information regarding how these requirements have changed the procurement procedures for public and nonprofit school food authorities (SFAs).

According to The School Code of Illinois, all food service management company contracts involving expenditures in excess of $10,000 must be competitively bid. Currently, vended meals contracts involving expenditures in excess of the $100,000 federal threshold must be competitively bid.

If your estimated contract cost will exceed the applicable threshold as outlined above, formal competitive sealed bidding procedures must be implemented to ensure compliance with federal and state regulations and statutes. These requirements apply to all new contracts. The SFA should also seek the advice of their legal counsel regarding local regulations and policies. An SFA not completing the required procurement procedures may not be approved for participation in a child nutrition reimbursement program.
