Duration of the Program
1. How long should students stay in a Bilingual program?
Students should remain in the program until they reach English Language Proficiency (overall composite score of 4.8 on Access 2.0)
2. How many years does the state require services?
State rules require at least three years of service for classified EL's.
3. Does PreK and K count as service years?
No, PreK and K do not count when calculating total years in the program.
4. May districts discontinue EL services to students who achieve English Language Proficiency prior to three years?
No, districts may not discontinue EL services to students who achieve English Language Proficiency prior to three years without parental permission (letter in the file).
5. Do students have to stay in the Bilingual program beyond three years if they did not reach proficiency?
Yes, students must continue in the Bilingual program beyond three years until they reach proficiency with parental notification (letter in the file).
Monitoring
1. How many years does a student have to be monitored when they exit the Bilingual program?
Students have to be monitored for 4 years after exiting the Bilingual program.
2. Do parents get a letter when their child exits the Bilingual program from the district?
Yes, parents have to be notified that their child exited the Bilingual program.
3. If a student exited before the 3 years but reached proficiency, does the student continue in the Bilingual program??
No, PreK and K do not count when calculating total years in the program.

Screened Scenarios
1. I have an incoming Kindergarten student that stated “yes” for one of the two questions on the HLS, was screened in preK and was English proficient, do I have to screen?
Yes, you do screen with the MODEL screener.
2. I have an incoming 1st grader, who has severe developmental speech delays and an IEP from Kindergarten, HLS says that another language is spoken at home, do I have to screen?
Yes, you do screen.
3. I have a 2nd grader who transferred from another district, HLS says “no” to both questions, but SIS lists “LEP status” as “yes”, do I have to screen?
Yes, however, if the student took ACCESS 2.0 the previous school year, the most recent scores should be used and the screener is not necessary.
4. Incoming 1st grader has an HLS that says, “yes” to one of the questions, was in general education in previous district and has good grades, do I have to screen?
Yes, but if the student took ACCESS 2.0 the previous school year, scores should be used and the screener is not necessary.
5. I have a 4th grader who just immigrated to the U.S. for the first time with his family HLS says “no” to both questions, do I have to screen?
No, however the district should ensure that the family understood the HLS questions.
6. I have a 9th grader who has an HLS that says “yes” to both questions, and she attended private school and never took ACCESS, yet scored in the 99th percentile on national normed test, do I have to screen?
No, the student was never identified previously, was in gen ed, and met/exceeded standards on a national normed test.
7. I have an incoming 9th grader who has an HLS that states “yes” to one of the questions on the HLS and she met the exit criteria in 6th grade, yet did not “meet” on a normed test this past Spring, do I have to screen?
No.
8. I have a 4th grader who has a HLS that states “yes”, he took the ACCESS 2.0 in 2nd grade and didn’t meet the exit criteria, however, was out of the country in 3rd grade during the ACCESS window and wasn’t tested, do I have to screen?
Yes, since her ELP scores are more than a year old.
